Terms of Service

The deal, in plain language.

These terms are short because the service is honest. The one clause we want you to actually read is Section 3 — it's the reason our continuity commitment is a contract and not a marketing page.

1. The service

PodAttr provides podcast download tracking and sponsorship attribution: a URL prefix that logs episode downloads, a pixel that logs sponsor-site events, and reports that match the two. "PodAttr," "we," and "us" mean the operator of podattr.com. By creating an account you agree to these terms.

2. Accounts, plans, and payment

3. Continuity: the 12-month notice, as contract

(a) Notice. If the Service is to be discontinued, materially degraded, or wound down — whether by our decision, a sale of the business, or a change of control — every active customer will receive written notice at least twelve (12) months before the Service ceases to operate for them. During that period the Service continues to function, and data export under Section 4 remains available at all times.

(b) Survival and assignment. This Section 3 survives any assignment, sale, merger, or transfer of the Service or of substantially all of our assets, and binds our successors and assigns. Any agreement transferring the Service must require the acquirer to honor this Section. We may not assign these terms in a way that extinguishes this obligation.

(c) Forced shutdown. If circumstances outside our control (such as insolvency) make twelve months impossible, we will provide the maximum notice the circumstances allow, state the situation plainly, and keep export and the published self-host path available for as long as we are able.

(d) The self-host path. The prefix worker is published under the MIT license at github.com/podattr/podattr-prefix. That license is irrevocable for released versions: no future owner of PodAttr can withdraw your right to run the published code.

4. Your data

5. Acceptable use

Don't use PodAttr to inflate, fabricate, or misrepresent download or conversion numbers; don't point the prefix at content you don't control; don't attempt to deanonymize listeners from attribution data; don't resell the Service without our agreement. We can suspend accounts that do, with notice and a chance to respond except where the abuse is ongoing.

6. Accuracy, warranties, and liability

Attribution is statistical measurement, not ground truth — our methodology describes exactly what a match means and where it can be wrong, and we'd rather you read it than rely on a warranty. The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. Nothing in this section limits the notice obligation in Section 3.

7. Changes to these terms

If we change these terms materially, active customers get at least 30 days' email notice before the change applies to them. Section 3 can be changed only in ways that strengthen it for existing customers — we can extend the notice period; we cannot shorten it for anyone who signed up under it.

8. Governing law

These terms are governed by the laws of the State of Colorado, USA, excluding its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Colorado.
